This privacy policy (this “Policy”) describes how and when Indi-Digital Wellness, LLC, (“Indi Moves,” “we,” or “us”), uses and shares your information when you use our Website at www.indimoves.com (the “Website”), as well as all related software, tools, systems, series and other services provided by us (collectively, together with the Website, our “Service”). This Policy also describes our use and disclosure of that information. By using our Service, you consent to the collection, use, and disclosure of personal information in accordance with this Policy. This Policy is incorporated by reference into the Indi Moves Terms of Service http://www.indimoves.com/terms and is subject to the provisions of the Terms of Service.

Personal Information

“Personal Information,” as used in this Policy, specifically identifies an individual end user of the Service, such as an individual’s name, address, telephone number, or e-mail address. Personal Information also includes information about an individual’s activities, such as information about his or her activity on our Service, and demographic information, such as date of birth, gender, geographic area, and preferences, when any of this information is linked to Personal Information that identifies that individual.

E-mail Newsletters. We may offer e-mail newsletters with announcements and information about Indi Moves from time to time on our Service. If you sign up for a newsletter or content, we collect your e-mail address. You may opt out of receiving e-mail newsletters.

Our Service or third parties may give you the ability to download Indi Moves software, register for an Indi Moves account, or to create and update a user profile on the Service. We may indicate that some personal information is required for you to download our software, register for the account or to create the profile, while some is optional. Integrated Service. You may be given the option to access or register for the Service through the use of your user name and passwords for certain services provided by third parties (each an “Integrated Service”), such as through the use of your Facebook credentials through Facebook Connect . By doing this, you authorize us to access and store the credentials you provide, your name, email address(es), date of birth, gender, current city, profile picture URL, and other information that the Integrated Service makes available to us, and to use and disclose it in accordance with this Policy. You should check your Facebook or other Integrated Service privacy settings to understand and change the information sent to us through Facebook Connect or other Integrated Service. Please review each Integrated Service’s terms of use and privacy policies carefully before using their services and connecting to our Service.

Our Service may contain interactive functionality that allows you to engage with other users on the Service, post comments to forums, to upload photographs and other content (the “User Content”), participate in surveys, and otherwise to interact with the Service and with other users. You may also opt-out from receiving commercial e-mail from us, and any other promotional communications that we may send to you from time to time (e.g., by postal mail) by sending your request to us by e-mail at [email protected] or by writing to us at the address given at the end of this policy. Additionally, we may allow you to view and modify settings relating to the nature and frequency of promotional communications that you receive from us.

Please be aware that if you opt-out of receiving commercial e-mail from us, it may take up to ten business days for us to process your opt-out request, and you may receive commercial e-mail from us during that period. Additionally, even after you opt-out from receiving commercial messages from us, you will continue to receive administrative messages from us regarding our Service.

Our servers and data centers are located in the United States. Indi uses the collected data to improve the functionality and user experience of the Indi App, to provide User support, and to communicate with Users. Indi may also share the data with partners, including employers, for business purposes.

Data Sharing

Indi reserves the right to share usage data with partners, including employers. All survey-related information will be blinded to partners and employers and presented in an aggregated format. This means that survey responses will not be linked to individual Users and will be presented in a format that cannot be traced back to any individual User.

Data Security

Indi takes the security of User’s data seriously and implements appropriate technical and organizational measures to safeguard User’s data.

Data Retention

Indi will retain User’s data for as long as necessary to fulfill the purposes outlined in this Policy, unless a longer retention period is required by law.

Data Access and Correction

Users may request access to their personal data held by Indi, and may also request that any inaccuracies be corrected.

Data Deletion

Users may request that their personal data be deleted by contacting Indi at [email protected]. Indi will comply with such requests unless a legal obligation prevents it from doing so.

Indi may update this Policy from time to time, and Users are encouraged to review it periodically. If material changes are made, Indi will notify Users through the Indi App or by other means.

Indi will comply with all applicable laws and regulations related to data privacy and security.

The Policy is prominently displayed within the Indi App and easily accessible to Users.

By using the Indi App, User acknowledges that User has read, understood, and agrees to the terms and conditions of this Policy.

Updates to this Policy

We may occasionally update this Policy. When we do, we will also revise the “last updated” date at the beginning of the Policy. Your continued use of our Service after such changes will be subject to the then-current policy. If we change this Policy in a manner that is materially less restrictive of our use or disclosure of your Personal Information, we will use reasonable efforts to notify you of the change and to obtain your consent prior to applying the change to any Personal Information that we collected from you prior to the date the change becomes effective.
